Guard Checkpoint website terms of use Version 2026-09-16-email-v2 1. Who provides the service Guard Checkpoint is operated by Vince Panozzo. Contact [email protected] for support, privacy enquiries or a complaint. These terms govern your use of the Guard Checkpoint website. You accept them personally as a user; your acceptance does not claim to bind your employer or customer to a separate commercial contract. 2. Authorised use and account security Use only an account and site access assigned to you. Keep passwords and registration keys private, do not share accounts, and notify your supervisor promptly if a phone, key or password is lost or compromised. Do not attempt to access another site's information, bypass access controls, falsify records or interfere with the service. 3. Recording tool, not a safety guarantee Guard Checkpoint records and reports checkpoint and patrol activity. It does not provide emergency monitoring, emergency dispatch or a guarantee that a person or property is safe. A tag scan is a record of an interaction with a tag; it does not by itself establish a completed inspection, identity of the person holding the phone, patrol quality, attendance for a whole shift or compliance with a contract or law. Missing or delayed records do not by themselves prove that a patrol did not occur. 4. Your operational responsibilities Follow your employer's and site's procedures, verify the correct site, tags, time zone, schedule and report recipients, and review records for errors. Use appropriate supervision and independent checks before making safety, employment or compliance decisions. Contact emergency services through the usual channels in an emergency; do not rely on this website to summon assistance. 5. Connectivity, availability and records Uploads can be delayed by connectivity, device settings or equipment faults. A report reflects the records available when it was generated; later uploads may change the information available. Check upload acknowledgements and investigate gaps. Keep any alternative records or contingency arrangements your operations require. The service may be interrupted for maintenance, faults or events outside our reasonable control. We do not promise uninterrupted or error-free operation, but these terms do not remove any standard of care or remedy required by law. 6. Information you enter and privacy Enter accurate information to the best of your knowledge and promptly report or correct errors using the available process. Only enter information you are authorised to provide and avoid unnecessary personal, sensitive or confidential information in notes. The privacy notice at /static/privacy.html explains how account, phone and patrol information is handled, including access by authorised site staff and configured report recipients. Acknowledging that notice is not consent to unrelated marketing and does not waive your privacy rights. 7. Acceptance records We record your account ID, username and displayed name, the server time of acceptance, and the exact agreement version and wording accepted. These records support administration and evidence of acceptance. They are retained with the service's audit records, subject to applicable legal obligations and lawful access, correction or deletion requests. You can view your acceptance receipt; authorised account administrators can view acceptance status and evidence within their existing permissions. 8. Service access and changes We may restrict access where reasonably necessary to protect the service, investigate misuse, comply with law, or implement an authorised site's access decision. Where practicable and lawful, we will explain the restriction and provide a contact for review. A material change to these terms will be presented for a fresh acceptance before continued website use. New terms do not retrospectively replace the wording recorded for an earlier acceptance. 9. Responsibility and legal rights You remain responsible for your own operational decisions and misuse of your account. To the extent permitted by law, we are not responsible for loss caused solely by inaccurate information supplied by others, unauthorised changes outside our control, or failure to follow reasonable operating and security procedures. This does not exclude our responsibility for our own acts or omissions where the law makes us responsible. Nothing in these terms excludes, restricts or modifies a consumer guarantee, statutory right, liability or remedy that cannot lawfully be excluded, restricted or modified, including under the Australian Consumer Law. These terms are not a blanket release from liability. 10. Questions, disputes and applicable law Contact [email protected] so we can try to resolve a concern. These terms are governed by the laws of New South Wales, Australia, subject to any mandatory law or right that applies to you elsewhere. Nothing prevents you from contacting a regulator or using a remedy available under applicable law. If you do not agree, select Decline and sign out and contact your supervisor about alternative arrangements.
